Welcome to Ocean ("we", "us", or "our"), an online music creation platform operated by Ocean Music Lab, a company incorporated in England and Wales (No. 12354456). Our service allows users to create, share, and collaborate on music compositions. We respect the intellectual property rights of others and expect our users to do the same.
This policy outlines our procedures for handling reports of copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws. It is our policy to respond to clear notices of alleged copyright infringement that comply with the DMCA.
Users of Ocean are strictly prohibited from uploading, sharing, distributing, or otherwise making available any material that infringes upon the intellectual property rights of any third party. This includes, but is not limited to:
We do not tolerate copyright infringement on our platform and will take appropriate action against users who violate this policy.
If you are a copyright owner (or authorised to act on behalf of one) and believe that content hosted on Ocean infringes your copyright, you may submit a DMCA takedown notice. Your notice must include all of the following information to be considered valid:
A physical or electronic signature of the copyright owner or a person authorised to act on their behalf.
Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
Identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g. the name of the sample in the sound library, or a URL to the content).
Your contact information, including your full name, mailing address, telephone number, and email address.
A statement that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorised to act on behalf of the copyright owner.
Please send all DMCA takedown notices to our designated copyright agent:
Ocean Music Lab
Email: feedback@oceanwaves.io
Please include "DMCA Takedown Notice" in the subject line of your email.
Upon receipt of a valid DMCA takedown notice, we will:
If you believe that your content was removed or access to it was disabled by mistake or misidentification, you may submit a written counter-notification. Your counter-notification must include:
Your physical or electronic signature.
Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which the address is located (or, if your address is outside of the United States, for any judicial district in which Ocean may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
Upon receiving a valid counter-notification, we will forward it to the original complainant. If the original complainant does not file a court action seeking to restrain the user from the allegedly infringing activity within 10-14 business days, we will restore the removed content.
In accordance with the DMCA, Ocean maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat copyright infringers. If a user is found to have repeatedly uploaded infringing content, their account may be suspended or permanently terminated at our sole discretion.
We may also limit the ability of any user to upload content if we reasonably believe they are likely to infringe on the rights of others.
Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
We encourage all users to consult with a legal professional before submitting a DMCA notice or counter-notification to ensure that their claim is valid.
We reserve the right to modify this DMCA Copyright Policy at any time. Changes will be posted on this page with an updated revision date. We encourage users to periodically review this policy to stay informed about how we handle copyright matters.
